Introduction
Terms and Conditions of Service. This document outlines the terms and conditions (the “Terms”) under which services are provided by Background Checks Australia, a trading name of Cybertrace Pty Ltd (“Cybertrace,” “we,” “us,” or “our”). By using our services, you (“the Client” or “you”) agree to and are bound by these Terms.
Services
We provide virtual/downloadable reports as a result of background investigations. The scope and nature of each investigation will be as agreed upon between you and us.
No Guarantee of Results
While we endeavour to provide thorough and accurate investigations, due to the inherent nature of such processes, we cannot guarantee specific results or outcomes. Our reports present information that is identified during our investigations, and sourced from available records and databases. The absence or presence of information in our reports does not infer or imply any specific conclusions.
Payment and Fees
All payments for our services must be made upfront unless otherwise agreed upon. The Client is responsible for any applicable taxes, charges, or fees that may arise in relation to the transaction.
Confidentiality
We respect the privacy of our clients and any individuals or entities under investigation. All information shared with us will remain confidential and will be handled in accordance with applicable privacy laws and regulations.
Intellectual Property
All content, including but not limited to our reports, methodologies, and tools, are the exclusive property of Cybertrace Pty Ltd. Unauthorized reproduction, distribution, or commercial use of any content provided by us is strictly prohibited.
Limitation of Liability
To the fullest extent permitted by law, neither Cybertrace nor any of its officers, employees, or agents will be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services.
Termination
We reserve the right to terminate or refuse service at our discretion, especially in cases where we believe our services may be misused or might lead to legal or ethical violations.
Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising out of or in connection with our services or these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Cybertrace reserves the right to update or change these Terms at any time. Clients are advised to periodically check this page for any updates. Continued use of our services after any changes signifies acceptance of those changes.
